so i got the official ruling from some higher up judges.

this works because it is and activated abilities and the restrictions on those abilities are bound to the planeswalker card type.

I played the deck a couple of times and it still does ok, but aggro usually runs it over. extremly resiliant to discard and land d but i found my self fetching the brain freeze out of the board to win ...
