if my opponent has teferi in play, can i tap my scepter in resp and play the spell? i know your still playing the speel, but wasn't sure if it was different because it was off an activated ability.

No you cannot play the spell. You're playing the spell during the resolution of the Scepter's ability. Therefore the stack is not empty and Teferi's ability prevents you from playing a spell when you're unable to play a sorcery (with a stack that is not empty).

he said in resp, so that is totally legal, as long as teferi is on the stack you are free to play spells

Your now very clear with what your asking. If terefi is in play no you can not play spells at instant speed with scepter. However if he is merely on the stack and that is what you are responding too you can play the spell.

sgtpepper87: The first thing he said was "Teferi in play". If he had said with Teferi on the stack my answer would have been different.

Jester's Scepter

Artifact

When Jester's Scepter comes into play, remove the top five cards of target player's library from the game face down. You may look at those cards as long as they remain removed from the game. ,tap, Put a card removed from the game with Jester's Scepter into its owner's graveyard: Counter target spell if it has the same name as that card.

Jester's Scepter ability is a triggered abiity for which is unnaffected by Teferi as it is not a spell. When you activate scepter, your ARE NOT playing a spell.
